For Process Servers Vancouver BC Is Worth Visiting

By Dennis Hill

Process servers refer to people whose work is to serve parties to a lawsuit with legal papers. To hold this position, one needs to be licensed by the government. Some of the legal papers that they serve include subpoenas, summonses, and court orders. Some of the parties to lawsuits who are usually served include defendants, plaintiffs, and witnesses. If the party being served is a corporation, the service is done through statutory agents. When one needs Process Servers Vancouver BC Offers the perfect location to visit.

On the other hand, individuals whose names are unknown to the court are usually served as John and Jane Doe. These monikers are then replaced with the real names of the parties once the court learns their real names. Process servers may be self-employed where they work with their own pools of clients. In some cases, they are employed by law firms and other organizations.

Constables used to undertake the roles of serving papers in the United States up to the time of coinage of the phrase private process server in 1930s. The term was invented to describe persons that could serve legal documents to lawsuit parties without necessarily being part of the law enforcement. Furthermore, the induction of private servers relieved the courts and law enforcement of the burden of serving documents.

The job description of these workers is straightforward. All they are supposed to do is to ensure that people are notified of legal action being taken against them in a timely and legal manner. The job may involve tracking down these individuals in order to serve them with the papers. Services that involve tracking down witnesses or defendants to serve them with papers usually cost more because of the work involved.

Attorneys, private and public companies, government agents, private citizens and law firms are some of the entities that employ servers. Server occupy a special position in the law enforcement system in that they are not employees of the court, yet they are court officials. The fact that these professional are not employed by the court limits them from working as attorneys or offering legal advice.

Although constables and sheriffs have been replaced by private servers in the duty of serving legal papers, this has not occurred entirely. Constables and sheriffs still serve legal papers in some cases. Actually, process servers only serve papers in civil cases. On the contrary, sheriffs and constables serve papers in both civil and criminal cases. It is only law enforcement officers that can serve legal papers like documents ordering property seizure and warrants of arrests.

Since there is a chance that people may mistake private servers of legal papers for law enforcement personnel, servers are disallowed from wearing uniforms. They are also required not to wear badges or put official-looking emblems on their vehicles when they are serving papers. This minimizes any chances of being mistaken by private citizens for sheriffs or constables.

Working in this job requires one to have some knowledge for the law. For instance, one must understand that some legal papers have an expiry time. Similarly, the papers need to be served in good time to allow witnesses or defendants to prepare themselves in advance. Also, those served need enough time to travel if necessary.
