The Easiest Ways To Avoid A Liquor License Violation

If you are opening a new restaurant, grocery store or quick stop shop in New Mexico, you are probably going to want to get a permit to sell alcohol. It may be a sound business idea, but you will have to get the city you do business in to agree. In order to do that you will have to fill out the forms and have the city commission or board review your application. They will consider your location, your business plan, and your personal history. They will also study how likely you are to commit a liquor license violation.

The rules and regulations regarding selling alcohol vary from state to state. One of the most fundamental rules found throughout the country and one that you, as a business owner, don't want to break is selling to minors. The individual may have identification and look old enough, but still be too young. If you have any question at all, you should err on the side of caution and refuse service.

One of the rules that has changed over the years is how culpable you can be if you serve or sell to someone who is clearly intoxicated. Most businesses have signs stating they have the right to deny service to anyone. If you knowingly sell a bottle or a drink to someone who has already had too much and the person gets involved in an accident, you might be held liable.

Casinos are one of the exceptions to rules about gambling and alcohol. Gambling is illegal in many states and, unless your licenses state otherwise, you are not allowed to permit slot machines or card games played for money in your establishment. If you have a nightclub and you want to have live entertainment, you will have to petition the city when you initially get licensed.

It should go without saying that your licenses may be in jeopardy if fights break out in your establishment. You may get by with a warning at first, but if this is something that happens frequently, you will probably find your licenses revoked, and it may be difficult to get them back. Illegal drugs and prostitution will immediately result in the revocation of your licenses.

A lot of time bars and restaurants like to run promotions to encourage new business, but offering free drinks as a prize in a contest is not usually a good idea. The state you do business in may not allow it. It may also not allow you to let someone run a bar tab with the promise to pay at the end of the night.

You can't transfer a license to someone else or try to obtain a permit for someone else. Owners who decide to expand their space, or reduce it, will have to have their plans approved and may see some of the permit rules change as a result. A felony conviction is cause for revocation as well as refusing to cooperate with law enforcement.

Before you start selling alcohol, either by the bottle or by the drink, you should clearly understand what is allowed and what is not. Your business may depend on it.
